New Canadian Citizenship Rules Open the Door for Millions of Americans

A quiet legal update in Canada is drawing major attention across the United States. Millions of Americans may now qualify for Canadian citizenship without realizing they already have a valid claim. The shift has sparked a wave of applications, long conversations about ancestry, and renewed interest in cross-border opportunities.

At the center of this change is a revised interpretation of citizenship by descent. For many families, it has turned what once seemed like a distant heritage detail into a legal status with real-world benefits.

Since the law took effect on December 15, immigration professionals on both sides of the border have reported a sharp increase in demand. Law firms are adjusting priorities to manage the influx of requests.

Nicholas Berning, an immigration attorney at Boundary Bay Law in Bellingham, Washington, described the situation clearly: “We’ve kind of shifted a lot of other work away in order to push these cases through.”

In British Columbia, attorney Amandeep Hayer has seen a dramatic shift in workload. His practice moved from handling about 200 citizenship cases per year to managing more than 20 consultations daily. That pace reflects how widespread the interest has become.

What Changed in Canada’s Citizenship Law?

Canada has updated its citizenship framework several times over the years. These changes often address outdated interpretations or correct past limitations in the law.

Previously, citizenship by descent applied only to one generation. That meant a Canadian parent could pass citizenship to a child, but not beyond that.

The new rule expands eligibility significantly. Now, individuals born before December 15 can claim citizenship if they can prove a direct Canadian ancestor. This includes grandparents, great-grandparents, and even earlier generations, provided they are properly documented.

For those born after December 15, an additional requirement applies. A Canadian parent must have lived in Canada for at least 1,095 days to pass on citizenship.

This shift has effectively reclassified many people as citizens from birth, even if they never held official documentation.

Citizenship by Right, Not Application

One key detail stands out in this process. Eligible individuals are not applying to become Canadian citizens—they are applying to confirm a status they already hold.

Amandeep Hayer explained it in simple terms: “You are Canadian, and you’re considered to be one your whole life. That’s really what you’re applying for, the recognition of a right you already have vested.”

He offered a clear comparison: “If a baby’s born tomorrow in Canada, the baby’s Canadian even though they don’t have the birth certificate.”

This distinction matters. It changes how applicants approach the process and how the law defines their identity.

Why Americans Are Exploring Dual Citizenship

The motivations behind this surge vary, but several patterns are emerging. Political concerns, global mobility, and long-term security all play a role.

Michelle Cunha from Bedford, Massachusetts, made her decision after years of political involvement. “I put in my best effort for 30 years. I have done everything that I possibly can to make the United States what it promises the world to be,” she said. “But clearly we’re not there and we’re not going to get there anytime soon.”

For others, international experiences have shaped their thinking. Troy Hicks of Pahrump, Nevada, recalled a moment during a trip abroad. “I recently went to Australia and… the first words out of the first person I talked to… were basically an expletive about Trump and the U.S.,” he said. “So the idea of doing that with a Canadian passport just seemed easier, better, more palatable.”

Family safety and future planning also influence decisions. Maureen Sullivan from Naples, Florida, pointed to events closer to home. After her teenage nephew encountered federal officers near his high school in St. Paul, she began to see Canadian citizenship as a practical backup option.

“When I first heard about the bill, I couldn’t believe it. It was like this little gift that fell in my lap,” Sullivan said. “There was kind of this collective excitement… we wanted to feel like we were doing something to take care of our security in the future if needed.”

Costs and Application Process

The financial side of obtaining proof of citizenship varies widely. For those with complete documentation, the process is relatively affordable. The application fee stands at 75 Canadian dollars, roughly $55 USD.

However, costs can rise when records are difficult to locate. Some applicants turn to attorneys or genealogists to gather essential documents such as birth, marriage, and death certificates.

Michelle Cunha estimated her total expenses at around $6,500 after hiring legal assistance.

Still, not everyone needs professional help. Mary Mangan from Somerville, Massachusetts, completed her application independently using online resources. She noted, “There are some situations where a lawyer might be the right thing, but for many people… probably 90% of people can do this on their own.”

Processing times remain a factor. Canada’s immigration office reports an average wait of about 10 months for citizenship certificates. As of now, more than 56,000 applications are under review.

Between December 15 and January 31, authorities confirmed citizenship for 1,480 individuals. In the previous year, 24,500 Americans successfully obtained dual U.S.-Canada citizenship.

Canadian Perspective on the Growing Interest

Within Canada, the response has been largely open-minded. Fen Hampson, a professor of international affairs at Carleton University in Ottawa, described Canadians as generally welcoming.

At the same time, some concerns have surfaced. A growing number of applications could place additional pressure on immigration systems already handling refugee and asylum cases. Delays may become a concern if demand continues at the current pace.

Canada’s updated citizenship law has reshaped how ancestry connects to legal identity. For millions of Americans, a family link that once felt distant now carries real meaning. The process is not about gaining something new—it is about confirming a status that may have existed all along.

As applications continue to rise, the trend reflects more than legal interest. It highlights shifting priorities, global awareness, and a renewed focus on long-term stability. Whether driven by opportunity, concern, or curiosity, many are now taking a closer look at their roots—and discovering a second nationality waiting to be claimed.
